The Stop Notice Bond must accompany a stop notice (Form 107) when served on a construction fund holder. Not required for Stop Notices on Public Work projects. The Stop Notice Bond is required on private work only -- not for public work contracts.
The Stop Notice Bond protects the person filing the Stop Order as it requires certain monies to be "tied up" for payment as listed in the Stop Order. If, for some reason, the Stop Order is invalid, the Stop Order Bond protects the person filing the Stop Order from Liability on that money that was "tied up".
